Sample Agreement to Sell Property

In consideration of your agreement to list the property described herein with you during the life hereof and to use your services to find a purchaser therefore including the distribution of this listing to other Real Estate firms, I hereby make, constitute and appoint you my exclusive agent with the exclusive right to sell or exchange said property, or any part thereof, at the price and terms stated herein or at such other price or terms of exchange to which I may agree: Said authority to be continuous until:

Thirty (30) days after receipt of written Notice of Cancellation.

During the life of this contract, if you find a buyer who is ready, willing and able to buy said property at said price and terms, or any other price or terms to which I may agree in writing or if I agree to an exchange of property, or if said property is sold or exchanged during said term, by me or any other person, firm, or corporation, or if it is sold or exchanged within six months after such expiration to any person to whom you or any other Real Estate Firm have previously offered it, I agree to pay you a commission of _______% of the sale price or $1,000, whichever is greater, and in case of the employment of an attorney to enforce any of the terms of this agreement, I agree to pay a reasonable attorney's fee and all costs of collection.

I agree to convey said real estate by good and sufficient deed, to transfer and deliver said personal property, if any, by good and sufficient bill of sale, to furnish title insurance, continued to date showing marketable title and right to convey. I hereby warrant that the information shown is true, that I am the owner of said property and that my title is a good and marketable title, that the same is free of encumbrances except as shown. I agree to pro-rate taxes, insurance, rents, interest, and other customary items to the date possession is available.
